Latest CFCB Appeals Chamber decisions announced

The UEFA Club Financial Control Body (CFCB) Appeals Chamber has taken decisions in the cases of three clubs that had appealed decisions issued by the CFCB First Chamber on 3 December 2021.

All cases concerned the non-fulfilment of the club monitoring requirements set out in the UEFA Club Licensing and Financial Fair Play Regulations, notably, the failure to comply with overdue payable requirements by regulated deadlines.

Sporting Clube de Portugal (POR):

The CFCB Appeals Chamber decided:

- To reject the appeal lodged by Sporting Clube de Portugal;

- To confirm the club’s exclusion from the next UEFA club competition (UEFA Champions League, UEFA Europa League and UEFA Europa Conference League) for which it would otherwise qualify in the next three seasons (i.e. 2022/23, 2023/24 and 2024/25), unless the club is able to prove by 31 January 2022 that it has paid the amount which was due no later than 15 January 2022 under a settlement agreement made on 26 November 2021 with another football club;

- To confirm the fine imposed of €250,000 on the club.

Real Betis Balompié (ESP):

The CFCB Appeals Chamber decided:

- The appeal lodged by Real Betis Balompié is partially upheld;

- To impose a fine of €150,000 on Real Betis Balompié;

- To impose a fine of €25,000 on Real Betis Balompié, unless it is able to prove by 1 March 2022 that it has paid an overdue amount due in respect of a former employee.

The CFCB First Chamber had decided to conditionally exclude Real Betis Balompié from participating in the next UEFA club competition (UEFA Champions League, UEFA Europa League and UEFA Europa Conference League) for which it would otherwise qualify in the next three seasons (i.e. 2022/23, 2023/24 and 2024/25) unless the club could prove by 31 January 2022 that it had paid the outstanding overdue amounts. Real Betis Balompié was also sanctioned with a fine of €250,000.

CD Santa Clara (POR):

The CFCB Appeals Chamber decided:

- The appeal lodged by CD Santa Clara is partially upheld;

- To exclude CD Santa Clara from the next UEFA club competition (UEFA Champions League, UEFA Europa League and UEFA Europa Conference League) for which it would otherwise qualify in the next three seasons (i.e. 2022/23, 2023/24 and 2024/25), unless the club is able to prove by 31 January 2022 that:

(a) it has paid the total amount due to social/tax authorities that was established as being overdue as at 30 September 2021, or

(b) it has, by 31 January 2022, concluded an agreement in writing which has been accepted by the social/tax authorities as extending the time for payment, and has made full payment of any sum due to be paid under that agreement on or before 31 January 2022.

- To impose a fine of €25,000 on CD Santa Clara;

- To impose a fine of €10,000 on CD Santa Clara, unless it is able to prove by 1 March 2022 that the club has paid an overdue amount due to another football club.

The CFCB First Chamber had decided to conditionally exclude CD Santa Clara from participating in the next UEFA Competition (UEFA Champions League, UEFA Europa League and UEFA Europa Conference League) for which it would otherwise qualify in the next three seasons (i.e. 2022/23, 2023/24 and 2024/25) unless the club could prove by 31 January 2022 that it had paid the outstanding overdue amounts. CD Santa Clara was also sanctioned with a fine of €75,000.
